Slanderous, sexual photos of my son were posted

Hi all,
I'm new here so I'm not entirely sure I'm posting in the right forum. Recently it was discovered that my 18 yr old son's photo was uploaded to a site more than 60 times with his full name and captions of a sexual, slanderous and defamatory nature. My son is a Freshman in college and these pictures were shown to him by someone in his dorm. Needless to say, my son is devastated as are my wife and I. We reported this to our local law enforcement but according to them, since my son is now 18 it isn't cyber bullying or a Hate Crime? They said all we have is a Civil case against the person(s) responsible for uploading the photos, which btw we own the copyright to. We then found out that the individual responsible is my son's ex-girlfriend that he broke up with several months ago. He contacted her and she admitted it was her and her college roommate. We met with our attorney who said its a strong case but the process will be at a cost and not just financially. The pictures were removed from the original site by this girl, but all 60 still appear when someone Google searches my son's name. Eventually they will disappear we were told, but we're of course still extremely upset, especially after being told that there isn't any recourse that can hold this girl accountable? Since it was created at her college dorm I was considering contacting the Dean of Students and filing a complaint. We feel so powerless and appreciate any advice. Thank you!
